Obligation of companies to consider safety

“Safety Obligation” refers to the obligation of a company or organization to consider the health and safety of its employees.

Article 5 of the Labor Contract Law stipulates that “companies must take care to ensure that employees can always work in a safe and comfortable working environment.”

In addition, the scope of employees to which companies and organizations should be obliged to consider safety is also stipulated in detail by law.

There are no penalties, but you may have to file a claim for damages if you violate it. It can be said that it is necessary knowledge for the sound operation of a company, so be sure to remember it from the person in charge involved.

What is a breach of the duty of care for safety?

A duty of care for safety is an obligation for the company to take care not to be exposed to the health and safety of its employees.

The obligation of safety consideration is stipulated in a law called the Labor Contract Law. Let’s check the text.

(Consideration for the safety of workers) In accordance with the labor contract, the employer shall take necessary care so that the worker can work while ensuring the safety of his or her life, body, etc.

Two Criteria for Determining Violation of the Duty of Care for Safety

There are two issues regarding whether a breach of duty of care exists: predictability and avoidability of consequences.

1. Predictability

Were you able to foresee the possibility of potential damage?

2. Outcome avoidability

Was it possible to avoid foreseeable damage?

Failure to take the necessary measures to avoid foreseeable harm while being foreseeable and avoidable is a breach of duty of care.

Therefore, the existence or non-existence of the above two points is an important point when determining a violation of the duty of care for safety.
